H-1B Request Process
An H-1B visa is for employees who come from a country other than the United States. The visa can be requested for up to three (3) years at a time, but its maximum duration limit is six (6) years.
H-1B petition requests should be submitted 6 months in advance of the hire date or current H-1B end date. Requests made under 6 months may require a fee to expedite. Due to the nature of an H-1B petition, it takes time to prepare and for it to be adjudicated by the United States Citizenship and Immigration Services (USCIS).

- Prevailing Wage Determination (PWD), varies (1-3 months)
- Labor Condition Application (LCA), 7 days
- LCA public posting, 10 business days
- Preparation of H-1B petition, (average 45 days)
- H-1B petition review and decision by the USCIS, varies (check with OIP for current processing timeframes)

H-1B REQUEST PROCESS
An H-1B visa can be requested for up to 3 years at a time, but should not exceed the maximum duration limit of 6 years unless an H-1B employee qualifies for an extension beyond the 6-year max per the AC 21 Act (Sections 104 and 106 of the American Competitiveness in the 21st Century Act).

- H-1B Department Questionnaire (filled out by the hiring department)
