Authorization
Dependents of J-1 exchange visitors are not automatically entitled to accompany the principal under J-2 status. Permission for dependents to apply for J-2 status is at the will of the exchange visitor program sponsor. Program sponsors have legal responsibility for monitoring and reporting on J-2 dependents as well as the J-1 principal.
Requirements
The exchange visitor must demonstrate the s/he will have sufficient funds to support all dependents, regardless of status, according to federal guidelines. J-2 dependents present in the U.S. during an exchange program are subject to the same requirements and restrictions for maintaining status as a J-1 visitor, this includes insurance requirements.
Employment
J-2 dependent spouses of exchange visitors may be eligible for employment. The spouse must demonstrate that the earnings are non-essential and will be used for supplementary purchases, such as vacation travel. Prior to engaging in any paid activity, the J-2 spouse must first obtain authorization from the USCIS in the form of an Employment Authorization Document (EAD). If an EAD is issued, the J-2 must then apply for a Social Security Number before becoming eligible for employment. These processes take at least four months. Education
J-2 dependents can study without restriction. If they are accepted into a program which involves an assistantship, they must first obtain an EAD card, or consider changing status to F-1.
