Clarification regarding pay for 'exempt' employees - Partial Day Absences
The Fair Labor Standards Act (FLSA) regulations make it clear that employers generally cannot dock their exempt employees pay for absences of less than a day without jeopardizing the exempt exemption. However, in 2005, the U.S Department of Labor (DOL) issued an Opinion Letter confirming that employers may deduct less than a full day from a salaried, exempt white-collar employee's Paid Time Off bank (sick leave, vacation) for absences due to personal reasons, accident, or illness, without causing the loss of the exempt status of the employee.
Therefore, KUMC current practice:
- An exempt employee who arrives at work but works less than four hours in that day, should receive four hours regular pay and four hours leave time (if available).
- An exempt employee who arrives at work but works more than four hours in that day, should receive eight hours regular pay.

Important Information regarding: Reporting Relationships in PeopleSoft 9.1
Clarification regarding work breaks and meal periods for hourly staff:
During the HR 9.1 upgrade training, there were questions raised regarding hourly employees work breaks and meal periods. The following information should be shared with hourly (nonexempt) employees in your departments.
- The purpose of paid work breaks is to provide a break during the first half and the second half of a work shift. Therefore, it is not appropriate to allow employees to use those breaks to arrive 30 minutes later, leave 30 minutes earlier, or extend the 30 minute lunch period.
- Full time employees should work their scheduled hours each day. If departments wish to allow their employees to have a period of more than 30 minutes for lunch, their starting or ending times should be adjusted accordingly
